Imposition of a driving ban due to gross negligence

When determining the duration of a driving ban, the effects of the measure on the livelihood of the individual penalised with a driving ban and their immediate mobility shall be taken into account. A reduction shall be made in respect of any period when the driver has not had the right-to-drive because of an offence that led to a driving ban.

The duration of the driving ban shall be determined on the basis of the number of day fines issued for the offence. If, at the same time, several offences are committed, when calculating the number of day fines, only offences regarded as endangering traffic safety shall be taken into account.

For gross negligence, a caution may be issued in place of a driving ban due to pressing reasons.
